Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE OPERATOR, BROKERAGE, WEBSTARZ, SERVICE PROVIDERS, LICENSORS, AND THEIR RESPECTIVE OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, OPPORTUNITIES, OR GOODWILL; OR DAMAGES ARISING FROM RELIANCE ON WEBSITE CONTENT, THIRD-PARTY SERVICES, SECURITY EVENTS, COMMUNICATION FAILURES, OR PROPERTY INFORMATION.
Where liability cannot be excluded, it will be limited to the greatest extent permitted by applicable law. Nothing in these Terms excludes liability that legally cannot be excluded.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Website Operator, brokerage, Webstarz, and their affiliates and personnel from claims, losses, liabilities, costs, and expenses arising from your unlawful use of the website, violation of these Terms, infringement of rights, misuse of listing data, or content you submit.
18. Governing Law, Venue and Dispute Terms
These Terms are governed by the laws applicable where the Website Operator conducts business, without regard to conflict-of-law rules, unless mandatory law requires otherwise. 19. Suspension and Termination
Access may be restricted or terminated without notice when reasonably necessary to protect users, systems, data, legal rights, service providers, or website operation, or when these Terms are violated.
20. Changes, Severability and Entire Understanding
These Terms may be updated by posting a revised version. Continued use after the effective date constitutes acceptance where permitted by law. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
These Terms and incorporated policies govern website use but do not replace a signed brokerage, representation, listing, purchase, referral, or other transaction agreement.
